GS2- Structure, Organization and Functioning of the Judiciary

  • The Supreme Court on Wednesday set aside its 2021 judgment that upheld the 2017 arbitral award asking Delhi Metro Rail Corporation (DMRC) to pay Rs 2,782.33 crore with interest to Delhi Airport Metro Express Private Limited (DAMEPL) promoted by the Anil Ambani-owned Reliance Infrastructure in connection with the construction of the Airport Metro Express Line project in the national capital.
  • Allowing a curative petition filed by the DMRC, a three-judge bench presided by Chief Justice of India D Y Chandrachud said that the order of the Delhi High Court division bench that set aside the arbitral award partly was a “well considered decision” and “there was no valid basis for” the Supreme Court to interfere.
  • The Supreme Court said it “erred in interfering with the decision of the Division Bench” of the high court.

Allowing curative plea, how Supreme Court pushes the envelope

GS2- Structure, Organization and Functioning of the Judiciary

  • Setting aside the 2017 arbitral award that required the Delhi Metro Rail Corporation (DMRC) to pay nearly Rs 8000 crore to Anil Ambani-owned Reliance Infrastructure, the Supreme Court has expanded the scope of its “extraordinary powers” to intervene beyond constitutionally prescribed processes.
  • A curative writ petition, that the Supreme Court has invoked in reviving the 2019 Delhi High Court judgment that partially set aside the Delhi Metro arbitration award, is a sparingly used judicial innovation to correct a “grave miscarriage of justice”.
  • Constitutionally, a final ruling of the Supreme Court can only be questioned in a review petition, that, too, on narrow procedural grounds.

GS3- Science and Technology- Developments and their Applications and Effects in Everyday Life

  • It required nearly 50 years, and the world’s biggest and most complex machine, to detect the Higgs boson in 2012.
  • An elementary particle like electrons, quark, photons or neutrinos, the Higgs boson, is known to impart mass to every other particle.
  • Its existence was predicted in the 1960s, but it was found only in 2012 through elaborate experiments carried out at the Large Hadron Collider, located on the border of France and Switzerland, the world’s biggest and most expensive machine till then.
  • The discovery of the Higgs boson completed what is known as the Standard Model of Particle Physics, which describes all the fundamental particles, like electrons and protons, and the forces, like electromagnetism, gravitation or nuclear forces, that build up the material part of the world.
